How far must you stop from a school bus with flashing red lights in New Jersey?

A school bus with flashing red lights and its stop sign out on a two-lane road, with a car stopped behind it and another car stopped in the opposite lane

A school bus ahead of you on a two-lane road has its red lights flashing. How close may you stop to it?

Answer choices

The answer

Stop at least 25 feet away and stay stopped until everyone has boarded or reached the roadside and the red lights have stopped flashing.

The 25-foot rule applies to drivers approaching or overtaking the bus, whether you are following it or coming toward it on a two-lane road.

On a divided highway the rule depends on which roadway you are on. Drivers on the same roadway as the bus must stop 25 feet away. Drivers on the other roadway may pass at 10 mph or less and must hold that speed until they are past the bus.

Exceptions

  • On a divided highway, drivers on the opposite roadway may pass at 10 mph or less instead of stopping.

Penalty

The MVC points schedule lists 5 points for improper passing of a school bus. A state education document also lists a fine of at least $100 for a first offense. Check the current statute for the full penalty.

Why this rule matters for safety

Children cross in front of and behind a bus, often where drivers cannot see them. The flashing red lights tell you someone may be in the road.

Stopping 25 feet back leaves room to see a child who steps out from beside the bus.
